The Terms and Conditions of Use stated below should be read and understood before completing your purchase of any digital products sold on this website. If you do not agree with any of the Terms and Conditions contained within, you should not complete your purchase.  Your purchase signifies your agreement with these terms and conditions.

I. LICENSES AND RESTRICTIONS

You understand and acknowledge that you are purchasing and downloading 100% Digital Content. The Arc Infographics and its related files are 100% Digital Content and you are subjected to the Terms and Conditions contained herein related to Digital Content. Meldia Architectural Corporation grants you a limited, non-transferable, revocable license to access and make personal, non-commercial, use of the Digital Content provided by Meldia Architectural Corporation and meldiaarchitecturalcorp.com including the Arc Infographics and its related files. You may print out one hard copy of each of the materials contained in the Arc Infographic for your own personal use. You may not share, sell, transfer, or give away any material contained within the Arc Infographics that is printed for your own personal use. You may not modify, alter, reproduce, copy, print (except for own personal use), share with coworkers, distribute copies of, resell, sell, lend, give away or in any way transfer any or all portions of the Arc Infographics and its related files in any format including digital and printed hardcopies that are utilized for your own personal use. You may not sell or post for sale Arc Infographics, in part or whole, or any of its contents on any internet marketplace or forum including, but not limited to, areforum.org, eBay or craigslist, Amazon, in any of its format including digital .pdf files, digital .mp3 files and printed hardcopies that are utilized for your own personal use. The license granted to you is for use of the Arc Infographics and its related files is for your own personal use. You may not share any portion, in whole or in part, of Arc Infographics. The license granted to you is for your own personal use and is non-transferable. You may not transfer it to anyone including, but not limited to, friends, family, and coworkers. If you purchase any items for sale on meldiaarchitecturalcorp.com, you are bound by all of the Terms and Conditions of Use contained herein.

II. FIRM OR CHAPTER USAGE RESTRICTIONS

Architectural or related firms, and any organization or entity, may not distribute the Arc Infographics or its related files to any of its employees unless a license is purchased for each employee. Purchasing a license for the firm library is not allowed and is in direct conflict and violation with the Terms and Conditions of Use contained herein. Licenses are granted only to individuals.  Firms violating this will be prosecuted to the fullest extent of the law with corresponding damages. American Institute of Architects (AIA) Chapters may not distribute Arc Infographics to any of its members unless a license is purchased for each member. Purchasing a license for the firm library is not allowed and is in direct conflict and violation with the Terms and Conditions of Use contained herein. Licenses are granted only to individuals.  Chapters violating this will be prosecuted to the fullest extent of the law with corresponding damages.

III. COPYRIGHTS 

All of the content contained within the Arc Infographics and its related files are copyright of Meldia Architectural Corporation. You may not post any of its contents on any public internet forum including, but not limited to, areforum.org, NCARB.org, or any publicly accessible server. The Arc Infographic is for your own personal use. You may not share your password with anyone. Accounts with access from numerous IP addresses will be locked. Meldia Architectural Corporation reserves the right to revoke the license to anyone suspected of sharing their username and password without warning and without refunding any fees paid.

IV. CHANGES AND UPDATES

Meldia Architectural Corporation reserves the right to make changes/updates to the meldiaarchitecturalcorp.com website, study materials, posted policies, and Terms and Conditions of Use at any time without notice or liability. 

V. RETURN/REFUND POLICY

You acknowledge that all Products and materials are non-refundable and not returnable, under any circumstances. All sales are final. 

VI. NO WARRANTIES

Products are provided “as is”. The Arc Infographics offers no warranty, explicit or implied, regarding any forms or templates, the accuracy of any information, or any rights or licenses under this agreement including, without limitation, any implied warranties of merchantability or fitness for a particular purpose. Obtaining materials available through the site is done at your own discretion and at your own risk. The Arc Infographics makes no warranty that the sites, products or materials will be accurate and reliable in all instances. In design, construction, contract negotiation, or real estate, Arc Infographics content never replaces the use of a competent licensed professional consultant, familiar with the particulars of the project.

VII. LIMITATION OF LIABILITY AND INDEMNIFCATION 

Except as prohibited by law, the Arc Infographic shall not be liable to you or to any other person or entity for any general, punitive, special, indirect, consequential or incidental damages, or lost profits or any other damages, costs or losses arising out of your use of the website, materials or products, including attorney’s fees and related expenses of litigation and arbitration. Except as prohibited by law, to the extent there is liability found as to the Arc Infographic, such recovery is limited to the amount you paid for materials, products and services. 

VIII. GOVERNING LAW; VENUE

These Terms shall be construed in accordance with, and governed in all respects by, the laws of the California. Any dispute between the parties concerning this Agreement shall be subject to the exclusive jurisdiction of the state and/or federal courts for Los Angeles County. The Arc Infographics reserves the right to change or modify these Terms at any time without notice to you. Again, it is your responsibility to review these Terms prior to use and periodically throughout your use of the Arc Infographics.
